Any grace period due to Covid

I think I know the answer to this question, but was encouraged to ask anyway.

We have a donor who funds an annual entrepreneur study away trip.  Last year, 2 of our students were planning to participate but because of Covid, their trip was cancelled. The students have since graduated.  If these now alumni were to participate in the entrepreneur study away trip, because their relationship to the College has changed, is the donor's gift to the College still a donation to the College?

Is there any sort of grace period or exception made because of Covid-related delays?

    Thank you for being kind.

Tough call.  I trust that the trip is a required component of the program and is normally required to graduate.  If not, it would not be easy to qualify the gifts as tax-deductible.  So, given that, inviting these two would no longer meet the educational requirements of the trip.  It would be more or less a boondoggle for them.

While you should get some advice from Counsel, I think the unspent funds from last year should go to additional students this year.

Supporting John with some additional thoughts . . .

What is the definition of who the 'annual entrepreneur study away trip' is for (e.g. how many students normally go on the trip that is funded)?   If alumni attending the trip is part of accomplishing the goal, then funding to support their attendance should be fine.  If they are the ONLY participants, I would say not.

Also - was the gift specific to trip in 2020?   If so, then asking the donor if the gift can used for this year's trip.

All to say - these opportunities should allow for additional conversations with the donor and internal stakeholders as to the purpose of the trip for the students/institution.

    Good luck!
