    Hello Friends!

    Does anyone have policy language they can share around GIK with associated copyright? For example, a donor wishes to give a painting to the museum but retain copyright. This is not a real example. Doesn't the associated appraisal need to cite copyright value?​ How do we address on receipt? Yes, I've also asked Legal. I've always rolled under the assumption that GIK are given without conditions, and this is what our current policy states. Thus, we own item 100%. However recently, an area of the organization has fashioned a unique document where copyright is broken out distinctly, and we've been asked to accommodate. This opens the future possibility that a donor may wish to donate a widget but retain copyright. I don't have policy or procedure to handle. I'd like to explore how you folks handle in policy.

    Typically, when intellectual property or artistic content is donated I've seen these issues addressed through a Deed of Gift document signed by both the donor and institution which has language clarifying matters such as intellectual rights transfer (e.g. copyrights, trademarks, etc.) outside transfer of any physical property.  I can share with you a document drafted at my former institution if you're interested.

    Here is an example of an addendum we include in a deed of gift if IP is involved.
