    A donor contributed a significant GIK to the institution more than three years ago.  Now, 4+ years later, the institution has put the GIK up for sale to the highest bidder and to their surprise, the original donor has placed a high bid to repurchase the item.  There is discomfort with reselling the item to the original donor - however, I think as long as the original donor is the highest bidder (and we are three+ years out from the original gift) - it may be ok?

    Realizing this is an unusual situation - I'm would appreciate any guidance offered.

    As long as the bidding was fair and completely open to the public, I get no heartburn.  I would make certain that there was wide knowledge of the sale, and no implied prospects of a sale to the donor at the time of the gift.  In other words, no "wink, wink; nod, nod." ��
