    Is it acceptable to begin to text constituents without an opt-in?  Can we send them an opt-in message and then begin texting? 

    What are the protocols, legal requirements, etc.

    Terry, generally speaking, nonprofits are exempt from the most stringent rules of the TCPA, see https://www.charitywatch.org/charity-donating-articles/charities-exempt-from-most-rules-regarding-telemarketing-calls-texts

    "regarding wireless numbers, any call or text by or on behalf of a tax-exempt nonprofit, including robocalls or a call/text made by an autodialer, is exempt only from the "written" part of the prior express consent provision of the TCPA. Therefore, prior express consent must be given by the individual being contacted on a cell phone, even if by or on behalf of a charity, but the express consent can be given orally. "

    Whether in practice you can actually record receipt of oral consent is a bit of a different matter, and so we recommend getting express written consent, as the burden of proving consent is on you. You must also disclose your org's identity when texting, and you must provide opt-out instructions with each text.

    Also, be aware that the following states have their own special laws regarding text solicitation - and I do not know how they regard nonprofit organizations:  Arizona, California, Colorado, Connecticut, Florida, Indiana, New Jersey, North Dakota, Oklahoma, Rhode Island, Utah, Washington, and Wisconsin.

    And speaking of states, charitable registration requirements apply to any form of solicitation.

    Hmm - I just got this re a recent Supreme Court ruling on this issue: https://www.natlawreview.com/article/us-supreme-court-limits-tcpa-liability-narrowly-interpreting-atds

    Basically, what it means is that for any organization, whether a business or a nonprofit, texting people from your CRM does not require any kind of consent to text people if you know their number (so you're not generating phone numbers) and you're not randomly choosing who to text. This is a major relaxation of the rules at the Federal level.

    Wait – I have a California Number and I live in Maryland, which rules apply? Maryland or California?
