Is this a gift to an individual?

    Hi all -

Wanted to run this by the group and see if it constitutes a gift to a specific individual rather than to the university. The donor says:

"I want to direct a restricted grant from a donor advised fund for Professor [Name of Professor] to use at their sole discretion in their teaching. Are there any restrictions, outside those of the IRS, that would prevent them from using the funds for student stipends, journal subscriptions, research expenses, and travel?"

I think the main thing we need to worry about is that the university must have "full control of the funds and discretion as to their use" per IRS rulings. How would you respond to this donor?

As long as the expenditures are 100% related to university academic purposes and none of the funding provides economic benefit to the professor, this proposal is fine. You will find attorney-approved gift acceptance policy language addressing this from NC State in the archives.
