    Which office at your organization coordinates the annual state charitable registration process.

    Does the primary responsibility reside in the Chief Counsel's Office, Finance or Advancement?

    Joe, I touched on this in the State Registration webinar Bob Burdenski, and I conducted earlier this year.  I think you can find it on YouTube.

    The answer is, "All of the above."  However, I find in my travels that Counsel and Finance typically don't want to have anything to do with the administration, but both will insist that this be done!  So, quite often, the Advancement Office gets to own this.

    When I was at NC State, I actually pushed for control over this when I ran the Advancement Services program.  It seemed to fit with my unofficial title of Compliance Officer.  But it really is all about fundraising, so I felt it belonged to Advancement.  I did, however, require the University to add a new budget line-item and funding to support these activities!

    Until recently, all our 25 campuses were responsible for managing their own registrations. This function lived in all sorts of places at the colleges-from Advancement offices to Legal, Finance, and (my favorite) the office of "TBD."

     

    Realizing that this was a challenge for many of our schools, I made a similar argument to the one John described below. I was successful in securing the necessary budget and leadership approval. So, as of a few months ago, the responsibility for state registrations is moving into CUNY's central office and under my Advancement Operations team. We will be working with the vendor directly and ensuring that all colleges are appropriately registered.

    We used Perlman+Perlman when I was at NC State.  For the webcast Bob & I did we had a guest from Copilevitz, Lam & Raney.  When also looked at Labyrinth when I was at NC State, and Harbor Compliance seems to get a lot of play these days.  However, there are a good 1-2 dozen competitors out there I have not evaluated.

    We moved to Copilevitz, Lam & Raney earlier this year from Harbor Compliance, where we had started having trouble. So far so good.

    May I ask others what their tracking, review and file storage process is (for those using vendors)? And how much FTE time is dedicated tot his work for those who are managing registrations for one entity, a well as what level of position oversees/manages registrations (eg, coordinator, associate, director?) and what other tasks this person has in their portfolio? The workload comes in waves based on renewal dates so it's not a FT position but time consuming during crunch time.

    I do a first review of completed forms, suggest edits to our vendor, and then submit forms to our legal team for a second review. Once they OK it, I can then forward on the forms to our CEO/CFO to review and approve for signature, and if they have edits, sometimes I can do them, others I need to go back to our vendor to edit. Eventually I email or mail them to our vendor, depending on whether wet signatures are required.

    I've struggled with the volume of email and version control of forms related to this work,` mostly during our peak renewal season April-June. I've tried to get my internal legal partner to work from a shared file in OneDrive, so that at least internally we're working from one set of forms, given that I'm sending edits back to our vendor, then sending them back to legal, but I haven't been able to make traction on this and forms end up going back and forth in email so I do the best I can to save forms and track statuses/next steps.
